This website, including any subdomains and mobile applications in relation thereof (the “Website”) is owned, controlled and maintained by Beauty Hall GP inc. doing business as Rennaï (“Rennaï”, “us” or “we”). When you access, browse, or use this Website or any of its features, you accept and agree to, without limitation or qualification, to the terms and conditions set forth below (“Terms of Use”).

These Terms of Use only govern access to and use of the Website and any features in relation thereto, and allow Rennaï to provide the services available through the Website. Regardless of how you access our Website, whether from a computer, a mobile phone device, a tablet, or other mobile device, these Terms of Use govern your use of our Website. For the applicable terms and conditions governing online purchases made or services received through the Website, please consult the Terms of Purchase.

For the purposes of these Terms of Use:

  • “include” and “including” means “including without limitation” and is not to be construed to limit any general statement which it follows to the specific or similar items or matters immediately following it;

  • “you” or “your” means the individual, if the individual is using or accessing the Website or purchasing products for his or her personal use.

This agreement comes into effect when you access our Website and/or make any order or purchase on the Website (the “Service” or “Services”) , including when you create your personal account to purchase products on the Website. BY ACCESSING OR USING THE WEBSITE, YOU ARE INDICATING YOUR ACKNOWLEDGMENT AND ACCEPTANCE OF THESE TERMS OF USE. PLEASE READ THESE TERMS OF USE CAREFULLY. 1. CHANGES TO THE TERMS OF USE
Rennaï reserves the right, at its sole discretion, to modify or replace any part of the Terms of Use, including the terms and conditions applicable to the creation and maintenance of a Rennaï account. In the event of any changes, Rennaï will provide at least thirty days notice by posting the updated Terms of Use on its Website and by sending an email notification to the email address associated with your Rennaï account.

By continuing to use the Website after the revised Terms of Use take effect, you agree to abide by the updated terms. If you do not accept the modified Terms of Use, please do not use the Website.

2. RENNAÏ ACCOUNT
In order to use all or part of the Website or the services provided therein, you may be required to create a Rennaï account. You are solely responsible for managing your Rennaï account and password and for keeping your password confidential. If you have forgotten your password, please click on the “Forgot Password” link and follow the on-screen instructions. You are also solely responsible for restricting access to your Rennaï account.
You agree that you are responsible for all activities that occur on your Rennaï account or through the use of your password by yourself or by other persons. This includes payments or purchases made by way of your Rennaï Account. If you believe that a third party obtained or guessed your password, use the password regeneration feature of the Website as soon as possible to obtain a new password.

3. CONDITIONS RELATING TO THE USE OF THE WEBSITE
As a condition to your use of the Website, you agree:

  • To keep the information provided to us in your Rennaï account accurate, current, and complete.

  • Not to impersonate or misrepresent your affiliation with any person or entity.

  • Not to attempt to probe, scan, or test the vulnerability of the Website or any related system or network or breach any security or authentication measures used in connection with the Website and such systems and networks.

  • Not to harm, harass or threaten to harm other users in any way or interfere with or attempt to interfere with the access of any user, host, or network, including without limitation, by sending a virus, overloading, flooding, spamming, or mail-bombing the Website or any feature, link, email address or prompt in relation to the Website or the provision of the services contemplated by the Website.

  • Not to provide us the payment information or payment credentials belonging to a third party.

  • Not to use the Website in an abusive way contrary to its intended use, to its documentation, or to Rennaï’s reasonable instructions.

  • Not to retrieve data or other content from the Website to create or compile, directly or indirectly, in single or multiple downloads, a collection, compilation, database, directory or otherwise, whether by manual methods, through the use of bots, crawlers or spiders, or otherwise.

  • Not to sell or resell products obtained or purchased through the Website or that you otherwise receive from Rennaï.

Rennaï reserves the right to investigate and prosecute violations of any of the above, including possible infringement or violation of any intellectual property rights and possible security breaches, to the fullest extent of the law, and to terminate your Rennaï Account or terminate your use of or block your access to the Website in the case of any of the above-mentioned breaches. Rennaï may involve and cooperate with law enforcement authorities in prosecuting users who violate the present Terms of Use. You acknowledge that, although Rennaï has no obligation to monitor your access to or use of the Website, it has the right to do so for the purpose of providing the Services through the Website, to ensure your compliance with the present Terms of Use, or to comply with applicable law or the order or requirement of a court, administrative agency, or other governmental body.

4. INTELLECTUAL PROPERTY
Unless otherwise indicated by us, all Website content is owned by Rennaï, or by others who have licensed their content to us, and is protected by intellectual property rights and other proprietary rights, including trademark rights and copyright.

Specifically, all rights, title and interest in and to the Website and the Services, including the Rennaï name and logos, trademarks and trade names, product or service names, slogans, designs, the look and feel of the Website, social media handles, domain names, text, images, pictures, data files and compilations, software, programs, algorithms, databases, and any other files relating to the Website, belong to Rennaï or our licensors, as applicable.

When accessing the Website or using our Services, you agree not to reproduce, copy, distribute, create derivative works, modify of or otherwise commercialize or use for any illicit purposes any of the Website content and materials, without the prior written permission of Rennaï. Your use of any such Website content or materials, except as expressly authorized by the appropriate rightsholder, shall constitute an infringement or violation of the intellectual property rights of Rennaï or a third party and could subject the infringer to legal action.

5. PRODUCT AND PRICING INFORMATION
Rennaï continually updates its product and service offerings in store and on this Website. Rennaï reserves the right to revise and/or discontinue product and service offerings at any time. Prices which may be displayed or advertised on the Website or through any other electronic communications from Rennaï do not include shipping fees and applicable sales tax, and are subject to change without notice at Rennaï’s sole discretion. The display of products and/or services on the Website does not constitute an offer to contract by Rennaï.

Online purchases of products available to be purchased on the Website are subject to Rennaï’s Terms of Purchase. Not all merchandise depicted on the Website is available for online purchase, and Rennaï reserves the right to limit the quantities of certain products which you can purchase through the Website. EXCEPT FOR QUEBEC CONSUMERS, in the event that an item is priced incorrectly on the Website, Rennaï reserves the right to not honour the incorrect price in its retail stores. Rennaï may publish blog posts on the Website which may feature, among others, product reviews, health and beauty tips, and other content of an editorial nature. All Website content and information provided therein, including product descriptions and images and blog posts, is intended to be used for informational purposes only, and are in no way intended to provide general health or medical information or be used to diagnose, treat, cure or prevent a medical or general health condition. We make our best efforts to provide product information that is as accurate as possible. Where Website content, including product information, images and/or blog posts, is inaccurate or incomplete, Rennaï will take the necessary measures to rectify such inaccuracy or omission. Furthermore, while Rennaï tries to accurately display the colours of products, the actual colours you see will depend on your device’s screen and may not be accurate. Products purchased through our Website or provided to you as a sample are for your personal use only and should always be used strictly in accordance with the product instructions for use and any applicable precautions or guidelines.

Our Website contains links to other websites which are owned and operated by third parties, such as Rennaï’s social media accounts as well as other third-party sites. These links allow you to exit the Website. The linked sites are not under our control and we are not responsible for the contents of any linked site or any link contained in a linked site or any changes or updates to such sites. We are not responsible for webcasting or any other form of transmission received from any linked site. We provide the links to you only as a convenience. We do not endorse the site or its use or contents, unless Rennaï has itself uploaded such content to its own social media accounts.

Our Privacy Policy describes the ways in which we collect, use, store, disclose and share your personal information and is hereby incorporated by reference into these Terms of Use. By using our Website or Services, you confirm that you have read and understood our Privacy Policy and you understand and agree to how we collect, use, store, disclose and share amongst ourselves your personal information and disclose such personal information to our authorized service providers and relevant third parties. We will only share your personal information in order to facilitate and administer your use of the Website and Services or otherwise if required by law. By clicking on this, you can receive information about the SSL digital certificate registration.

Nonetheless, Rennaï provides you with products and services through the networks of other telecommunications providers and through other suppliers and third parties. Other than as provided for in our Privacy Policy, Rennaï assumes no responsibility for the security of your devices, facilities or networks used to access our Website and use our Services or for unauthorized access to such devices, networks or facilities. In all cases, you are responsible for determining and establishing secure network access configurations to access and use the Website.

RENNAÏ'S ENTIRE LIABILITY SHALL BE LIMITED TO (AND SHALL NOT BE MORE THAN) REPLACEMENT, REPAIR, OR REFUND OF THE PURCHASE PRICE PAID BY YOU TO RENNAÏ FOR THE APPLICABLE PRODUCT (IF ANY), AT RENNAÏ'S SOLE OPTION.

11. INDEMNIFICATION
You agree to defend, indemnify, and hold Rennaï and its officers, directors, affiliates, employees and agents harmless, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Website as well as your Rennaï Account in relation therewith.

12. GOVERNING LAW AND JURISDICTION
Not applicable to Québec consumers. These Terms of Use are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to any matters relating to your access to or use of this Website or to any product sold or purchased through the Website, or to any aspect of your relationship with Rennaï.

To the fullest extent permitted by law, all disputes and disagreements arising out of or related to these Terms of Use shall be exclusively submitted for, resolved and finally settled by, binding arbitration, and the Parties waive any objection that might be made on the ground that such venue may be in an inconvenient forum. Where arbitration is not permitted by law, all disputes and disagreements arising out of or related to these Terms of Use shall be resolved exclusively in the Courts of the City of Toronto, Province of Ontario.

FOR QUÉBEC CONSUMERS ONLY, these Terms of Use are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to any matters relating to your access to or use of this Website or to any product sold or purchased through the Website, or to any aspect of your relationship with Rennaï. Any disputes and disagreements arising out of or relating to these Terms of Use shall be resolved exclusively in the Courts of the district of Montreal, Province of Québec.

13. MISCELLANEOUS PROVISIONS
Waiver. Rennaï will not be considered to have waived any of its rights or remedies described in these Terms of Use or the Purchase Terms unless the waiver is in writing and signed by Rennaï. No delay or omission by Rennaï in exercising its rights or remedies will impair or be construed as a waiver of its right to enforce such rights at any time.

Entire Agreement. Not applicable to Québec consumers: The Terms of Use constitute the entire and exclusive agreement between Rennaï and you regarding the Services, and the Terms of Use supersede and replace any prior agreements between Rennaï and you regarding the Services.

Severability. If any one of these conditions shall be deemed invalid, void, or for any reason unenforceable, such condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

Assignment. Rennaï shall be allowed to assign the Agreement to any third party without requiring your consent, but you may not assign this Agreement without the prior express written consent of Rennaï, which may be withheld in our sole discretion.
